Terms of Service

These Terms of Service ("Terms") govern your access to and use of the StackTracker website and related services (the "Service"). By using the Service, you agree to these Terms.

Use of the Service

You may use the Service for lawful, personal, non-commercial research unless we agree otherwise. You agree not to misuse the Service, attempt unauthorized access, interfere with other users, or use automated means in a way that harms the site or other users.

Accounts

If you create an account, you are responsible for your credentials and for activity under your account. Notify us of any unauthorized use if a contact method is available.

Content and information

Shoe data, reviews, scores, and recommendations are for general information only. They are not professional, medical, or training advice. Always verify information with manufacturers, retailers, and qualified professionals before purchasing or changing your training.

User content

If you submit ratings, comments, or other content, you grant us a license to use, store, and display that content as needed to operate the Service. You represent that you have the right to post your content and that it does not violate others' rights.

Intellectual property

The Service, including its design, text, and software, is owned by StackTracker or its licensors, except where third-party or user content is indicated.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STACKTRACKER AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER, UNLESS MANDATORY LAW PROVIDES OTHERWISE.

Indemnity

You agree to defend and indemnify us against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

Changes

We may modify these Terms or the Service. We will try to post material changes; continued use may constitute acceptance. Check the "Last updated" date at the top of this page.

Termination

We may suspend or terminate access to the Service for conduct that we believe violates these Terms or is harmful to others or the Service.

Governing law

These Terms are governed by the laws of the jurisdiction where the operator of your StackTracker deployment is based, without regard to conflict-of-law rules, unless local law requires otherwise.
